MAAG, DUB, ECRU, VILET GIFT CARD GENERAL TERMS OF USE

1. The Gift Card (hereinafter, the Card) is owned by New Fashion JSC (INN (Taxpayer Identification Number) 7707099460) (hereinafter, the Seller), the Card possessor being its Holder.

2. The Holder fully accepts all the Card General Terms of Use (hereinafter, the Terms of Use) and undertakes to independently review all amendments that may be made to the Terms of Use by the Seller.

3. Each current version of the Terms of Use shall be valid from the date of its approval by the Seller till the date of the Seller's approval of a new version of the Terms of Use. The Card use is always governed by the latest valid version of the Terms of Use, even if the Card has been purchased subject to prior versions.

4. The following types of Cards are available: a plastic card intended for sale at points of sale of New Fashion JSC goods in the Russian Federation (New Fashion JSC stores).

5. The Card may be used to purchase any item offered for sale in New Fashion JSC stores.

6. The Card may be paid for by any method accepted for payment in New Fashion JSC stores. The Card may not be paid for with another gift card.

7. The Card may be used an unlimited number of times until one of the following events occurs: the Card amount is completely spent or the Card expires.

8. The interim balance of the Card is a difference between the Card's available balance before making a purchase and the amount used to make such purchase. If the purchase amount exceeds the available balance on the Card, the difference may be paid by any method accepted for payment in New Fashion JSC stores.

9. The available balance of the Card is indicated on the receipt each time a purchase is made in New Fashion JSC stores using the Card. The available balance can be checked in any New Fashion JSC store. Until proven otherwise, the available balance shall be deemed the balance determined at the cash desks of New Fashion JSC stores.

10. Goods purchased with the Card in New Fashion JSC stores are subject to exchange and return on the terms and conditions established for any purchases made in those stores.

11. Refunds for returned goods purchased with the Card shall be performed as follows:

• 11.1 By replenishing the available balance of the Card, provided that the Card is available at the time of such return.
• 11.2 If the Card is missing at the time of goods return:

• 11.2.1 Funds for goods purchased in New Fashion JSC stores shall be refunded to the Purchaser in accordance with the rules for goods sales in New Fashion JSC stores. If the Card is missing (lost) when goods paid for with the Card are being returned, the funds will be returned to the Purchaser's personal bank settlement account.

• 11.3 The above methods of return are material conditions and deemed accepted by the Purchaser upon purchasing and/or using the Card.

12. The Card is valid for three (3) years from the date of its purchase. Upon expiration, the Card may not be renewed or used to purchase goods, nor the available balance is subject to refund.

13. The Card belongs to its Holder. The cardholder is fully responsible for its use and storage. The Card is not subject to replacement if stolen, lost, or damaged. If the Card is lost, it may be neither blocked nor restored, the Card balance is not refundable. At the same time, New Fashion JSC may replace the Card in case of a change in the Card format.

14. The Card is not inscribed with the holder's name. The Purchaser may transfer the Card to any Holder on any legal basis, including as a gift. The Seller is not liable for transferees of the Cards or for conditions of and grounds for such transfers by the Purchaser or another Holder. In any case, the Holder's receipt of the Card means that he/she has read and understood the Terms of Use and consents thereto.

15. Cards acquired by any illegal means will be cancelled or invalidated and may not be used to purchase goods. The above Cards are non-refundable.

16. The Cards shall not be used for advertising and promotion of goods and services by any third parties, except for persons issuing these Cards, without the Seller's prior written consent.

17. By participating in this program, the Purchaser accepts these Terms of Use and confirms that he/she is a consumer, i.e., purchasing goods solely for personal and family needs, and not for business activities, while retaining all rights granted under the applicable Russian laws.

18. By accepting these Terms of Use, the Purchaser represents and warrants that he/she does not intend to obtain unjust enrichment from banks or other organisations, among other things, in the form of "cashback" for the purchase of goods by purchasing such goods and refusing (returning) these goods.
